SOLUTION - BIOETHICS

1.) Is there any responsibility

The Barrio People
The Barrio people have the responsibility to help Mr.X as being part of the community and society; they had the responsibility as a citizen to help people who are in need. The barrio people had disrespected Mr. X as a human being and they are all immoral in their actions and their values and beliefs must be corrected so in the future there would be no other Mr. X. Even they believe that Mr. X is being possessed by an evil spirit and even they don’t know anything about psychiatric illness, still there is no excuse in their actions because ignorance excuses no one in the law. Therefore, in our opinion and analysis the barrio people must suffer on the hands of law. They can be charged of the following:

-Battery- Touching with or without the intent to do harm.

False Imprisonment- Intentional confinement without authorization by a person who physically constrict another by using force, threat, of force or confining structures and or clothing ; even without force or malicious intent; to detain another person without his consent.

Restrain of an individual without sufficient justification is false imprisonment.

-False imprisonment because they tied up Mr. X without the authority of Mr. X, they could be a better way to restrain Mr. X but not in a mango tree naked, untidy, and with multiple bruises. It was so inhuman to do such things.

Nursing attendant:
The nursing attendant was not doing his job as part of the hospital and as a part of the health care team. As being part of the health care team in any institution, the nursing attendant has the responsibility to safeguard the life of Mr.X and uphold his dignity, avoid physical harm and to safeguard the patient. The nursing attendant is legally liable on different grounds. First passing his job and responsibility over a psychiatric patient without proper supervision; every member of the healthcare team has a specific responsibility based on their profession, attainment, and skills. Nursing attendant has a standard treatment to follow and obey, they have a proper description off their jobs, they also have specialized training to fit to their job, and they have to follow the set rules and obligation of the institute in order to render proper service.

It must be borne in mind that the patient’s life is first and foremost protected and defended as a matter of fundamental right

Does the incoming nurse is legally and ethically liable? Yes or no? Why

What are the ethical and legal issues that can be raised on this case?
Shift nurse (Nurse I) - if you believe he’s responsible...
Incoming nurse (Nurse II) – if you believe he’s responsible..,

Does Mario, co-patient of Mr. X, is legally liable or not?
Mario the co-patient of Mr. is suffering from a mental illness therefore Mario has no capacity to foreseen his actions or to realize his actions. He is suffering too, that way Mario needs professional help. Marion he is bombarded with different stresses or problems to cope as person. Therefore, Marion is not liable in his actions over the death of Mr. According to law in exempting circumstance any insane person or a person who’s suffering from mental illness is not liable on his actions unless it was proven that there is a lucid interval.

What are the patient’s right’s violated on this case?
Who are the people liable for the tragic death of Mr. X? The incoming staffs, outgoing staffs, attendants, administration, or supervisors?

Human Right and the Mentally Ill:
Discrimination was particularly widespread in mainstream society, with the mentally ill experiencing “stigma and discrimination” or even “misunderstanding and mistreatment” in almost every aspect of their lives’ ranging from restrictions or eligibility for insurance and superannuation schemes, to employment, education and training. It is widely known that people suffering from mental illness are among the most stigmatized, discriminated against, marginalized, disadvantaged and hence vulnerable individuals in our society.

Mentally ill suffer from a widespread, systematic discrimination and are consistently denied the rights and privileges to which they are entitled.
